General Terms and Conditions for Merchants

These General Terms and Conditions were adopted and approved on 30.08.2023.

GENERAL CONDITIONS FOR MERCHANTS

These General Terms and Conditions specify and regulate the rules and the process of purchase and sale between the online store (hereinafter referred to as the merchant store) owned by ARSY COSMETICS LTD and its customers legal entities merchants.

TERMS

  1. "ARSY COSMETICS" Ltd. is a company registered in the AB-Commercial Register with the UIC 040195939, headquartered in the town of RUDOZEM, street Khan Krum, № 19, providing goods on-line through the electronic platform arsy-cosmetics.com;

    2. User/Customer - a legal entity that has registered a customer account and has agreed to these General Terms and Conditions and the Data Protection Declaration;

    3. Customer profile - information about a legal entity merchant, which he himself has provided when filling in the registration form, and which is stored by the store for merchants for the purpose of servicing and fulfilling the order placed;

    4. Wholesale selling price - the price for a certain quantity of goods/articles set for traders only, including VAT but excluding transport costs and excluding cash on delivery charges.

 

REGISTRATION, ORDER AND PURCHASE

HOW TO REGISTER AS A TRADER

In the Arsy Cosmetics Ltd online shop for merchants you can create a registration:

1. To make shopping faster, more convenient, easier, without having to specify and type the same data every time;

2. To be able to view your order history.
When filling in the registration form, the legal entity trader guarantees that the data provided by him is correct, true and accurate. In the event that incorrect and inaccurate data is provided, the owner of the online store has the right to delete the maintained customer profile of the registered merchant, without prior notice to the legal entity merchant. The customer is fully responsible for the protection and non-dissemination of his/her access password, as well as for all actions that are performed through his/her customer profile.
The online shop for merchants will allow a choice of English and Bulgarian versions and language.

When the Customer chooses the Bulgarian version and Bulgarian language and registers for the first time, if it is a foreign legal entity - trader, VAT ID is required for registration, along with the relevant company details. These users will not be automatically approved, but the site owner's administrator will do a manual activation in the site administration after checking the VAT ID in the VIES system. The user will then automatically receive an email that they have been activated. If it is a Bulgarian legal entity trader, the entry of the UIC, together with the relevant company details, is required for registration to take place. If the UIC number of the legal entity trader is not provided the registration cannot proceed until the trader tick is removed and therefore the trader is registered as the end customer - an individual.Each registered user will be able to be activated once as a trader in the system. Upon this activation, he receives a one-time email informing him of this and he can now place orders as a trader. If a trader wants to be able to place an order as an end customer, he must create a separate account. In case the trader wants to change his UIC (for local traders) or VAT ID (for international traders), his account is blocked and the entered data is checked again. If they do not correspond to the relevant legal entity, their account may be deleted without notice.When logged in as a Bulgarian merchant, the user sees the prices for merchants with VAT included everywhere, and when logged in as a foreign merchant with a valid VAT ID, he sees the prices without VAT included.
If a user is logged into a particular version of the site, for example a Bulgarian legal entity in the Bulgarian version and a foreign legal entity in the English version of the site, they are no longer able to change the language version of the site or order in a language other than their chosen language.
The English version of the site provides registration only for foreign legal entities.

 

CONDITIONS HOW TO ORDER

To place an order, once the Customer has reached the desired product, it is sufficient to select and click on the "Add to Order" button. The selected product will be automatically transferred to your cart/basket, which is located in the upper right corner of the page. After entering your cart, you can make adjustments to the quantities requested and ordered, delete some products or add newly selected products. Once you are satisfied that the products you have selected are in your cart/basket and they match the quantities you have requested, please click the "Order" button. After pressing the "Order" button, the user/customer agrees to purchase the goods/articles that are in their cart. This action is legally binding between the merchant and the user/customer. The customer receives confirmation of the order, and upon receipt of this confirmation the contract between the parties is deemed to be concluded. After pressing the "Order" button, our system will display a message on the screen that the order has been accepted.
"ARSY COSMETICS LTD has the right to refuse delivery of an order already confirmed in the event and provided that the goods/articles are not available. When there is a lack of stock of the requested and ordered goods, ARSY COSMETICS Ltd. sends a notification to the customer within the working week and notifies him of its exhaustion by sending an electronic message to the electronic address (email) specified and provided by the User/Customer. If a bank transfer is made to the merchant's account, the customer/user has the right to choose between refunding the amounts already paid, cancelling the order or sending a replacement order.
The language in which the trader and the customer (Bulgarian legal entity) will communicate and correspond is Bulgarian. The language in which the trader and the customer (foreign legal entity) will communicate and correspond is English.

TERMS OF DELIVERY

 

After the order is placed, ARSY COSMETICS Ltd. issues a pro forma invoice without transport costs included. Once the amount of the pro forma invoice is credited to the account of ARSY COSMETICS Ltd. within 7 working days we send an email confirmation with the necessary logistical information to the customer. The organization of transport and the respective costs are at the expense of the merchants. The ordered goods shall be collected from the warehouse of "ARSY COSMETICS" Ltd. located at: 4970, Village Elhovets, Rudozem Municipality ( Industrial zone) within the time specified in the confirmation email.
No dispatch fee will be charged for legal persons trading in the English version. The non-resident trader must arrange collection and transport of the goods ordered at his own expense following instructions from ARSY COSMETICS Ltd.

 

CONDITIONS AND OPTIONS FOR WITHDRAWAL FROM AN ORDERED PRODUCT AND COMPLAINT

 

Opportunities for cancellation of ordered product and return:
The Buyer, in accordance with the Consumer Protection Act, has the right to return or exchange the Product/item ordered by him within 14 /fourteen/ calendar days from the date of delivery to the address specified by the customer or from the date of arrival of the item/item at the office of the courier company. When the buyer states that he wishes to return or exchange the product/good ordered by him within fourteen days, he should notify ARSY COSMETICS LTD and return the Product/good as follows:
1. With the original labels/stickers, without any indication or trace that the Product has been used, used or damaged in any way.

2. The Product/goods must be in its original undamaged packaging, box / crate/.

3. An invoice and financial document for the payment made must be attached. Returned items for which an invoice and financial document for payment have been issued but are not attached to the returned goods will not be accepted.

4. When returning or exchanging goods/articles, it is a mandatory condition when exchanging or returning the product that a FRAGILE sticker/tag is affixed to the product/goods, this fact to be stated by the customer to the courier company when handing over the product/goods.

Upon exchange or return, each shipment will be inspected and if any of the above requirements are found to be missing, the shipment will not be accepted and no refund will be issued.
The item can be replaced with the same or a new one, and in case of price difference the amount will be refunded to the customer's bank account, or will be surcharged by the customer. Refunds will only be made to the customer's bank account within ten (10) business days of the customer providing their bank account. The bank account shall be provided by the customer to the following e-mail: sales@arsy-cosmetics.com.
It is possible to make a complaint in case of non-conformity of the goods received with the ordered ones or in case of lack of product from the shipment. In these cases, replacement or receipt of the missing product is made in a subsequent order.

When products are missing from the shipment and when the store cannot satisfy/fulfill the order, i.e., there is no stock of the given product, then the store may offer the customer alternative products of the same value. When the customer refuses the replacement products, the trader/store shall undertake to refund the relevant amount.

 

PROTECTION OF YOUR PERSONAL DATA

 

In order to carry out the service of selling the goods/articles, it is necessary for the customer/user to submit information. This information is kept within the meaning of the Data Protection Act. The personal information given by you is only used to fulfil your order. If you would like more information in this regard, please open the data protection declaration attached on our website.

 

CHANGE OF PRICES AND GOODS

The goods/articles and their prices indicated on the online shop platform may be changed at any time, without necessarily notifying the users.
The user shall pay the price that is indicated as current at the time of placing the order.
In the event of a price reduction of an item, the new price is announced next to the old price, which is crossed out.
If there are any technical errors made by the customer/user concerning the information required from him/her to place the order, the shop shall be entitled to refuse the order placed without compensation to the user.


CONSUMER PROTECTION LAW

According to the Consumer Protection Act, the main characteristics of the product/goods are described on the product's presentation page.
The price of the product/article is displayed on the same page on which the product/article is presented. The cost of transport is not included in the price of the goods. It is stated separately in the order and is charged when determining the final value of the order.
There is no additional value charged when using the provided telephone numbers and any forms of contact.

TERMS AND METHODS OF PAYMENT

 

  1. Online payment by credit or debit card, using an online terminal.

  2. Bank transfer. If this payment method is chosen, the processing and receipt of the order is carried out after receipt of the bank transfer. In the event that the Seller does not receive payment from the Customer within 5 (five) calendar days from the date of the pro forma invoice, "ARSY COSMETICS" Ltd will assume that the Customer has abandoned the order placed and will not execute the same. Regardless of the bank receiving the transfer amount, bank charges are always borne by the buyer so that the MERCHANT receives the full amount of the transfer.

The MERCHANT reserves the right to amend and supplement these General Terms and Conditions at any time, with all such amendments and supplements coming into force automatically, from the moment of their publication on the SHOP's website: www.arsy-cosmetics.com, without the need for prior consent of the users. It is the user's obligation to familiarize themselves with the amendments and additions to the General Conditions when using the site.
